I. Policy
  1. Free expression and peaceful assembly are rights guaranteed by the Constitution, subject to time, place and manner regulations. The institution acknowledges this right for its students to assemble and express their views peacefully. To protect the health and safety of both participants and bystanders, peaceful assembly procedures follow. (See also Policy E-6.2, Student Rights and Responsibilities Code).

  2. PROCEDURE
    1. PREPARATION STRATEGIES

      1. Plan and Prepare.
        1. Plan your peaceful assemblies through the Vice President for Student Services Office.
        2. Seek help from the Student Life Office to ensure compliance with federal, state, and local law as well as institution policies.
        3. Reserve an appropriate location from the list below.
        4. Schedule appropriate amplification, if necessary.
        5. Contact University Police for traffic and crowd control, if necessary.
        6. Post fliers and/or cardboard signs according to the University Poster Policy.
        7. Pay rental charges, if required.
        8. Commit to obey local, state and federal laws and institution policies.
        9. Agree not to disrupt the educational process of the institution.

    2. PROHIBITIONS
      1. Interference with the rights of others. Examples are harassment, intimidation and discrimination.
      2. Disruption of normal functions of the institution (U.C.A. 76-8-703).
      3. Damage to institution property (U.C.A. 76-8-706).
      4. Endangerment of the health or safety of self or others.
      5. Use of classrooms during academic hours.
      6. Refusal to vacate the premises upon official request by an institution administrator or Law Enforcement personnel (U.C.A. 76-8-703, 704, 710, and/or 713).
      7. Use of objects that might injure participants or bystanders. Examples are wires, ropes, sticks and chains.

    3. PENALTIES
      1. Prohibited acts are grounds for suspension or dismissal. Utah law provides that a student may be barred from the institution for up to 14 days following an incident where the student violates institution policy or state law. (U.C.A. 76-8-711).
      2. Refusal to vacate premises upon official request warrants immediate temporary suspension and arrest under the law (U.C.A. 76-8-703, 704, 705).

        3. Sorensen Student Center Ballroom
        4. Sorensen Student Center Theater
        5. Athletic fields/Lawn areas
        6. Sorensen Student Center Meeting Rooms
        7. McKay Events Center Arena
        8. McKay Events Center Presidential Level

      2. Small assemblies (fewer than 50 people)
        1. Student Lounges
        2. UVUSA Meetings (SC 213)
        3. Locations are subject to availability; some locations may not be available at all times due to previously scheduled engagements.

        4. Amplification for the Sorensen Student Center and outdoor areas can occur between 11:00 a.m. and 1:00 p.m., Monday through Friday. Saturday hours are flexible. Adequate and effective amplification will be provided within limits necessary to protect the neighboring community. Amplification for small peaceful assembly sites is rarely needed.
