What is being added with this policy? This policy is a new policy that is required by the Utah Board of Higher Ed Policy R555 Providing Facilities, Goods and Services in Competition with Private Enterprise. Policy R555 requires institutions to establish a written policy addressing competition with private enterprises. Institutional policies must require institutions to comply with R555; provide a grievance process; designate an individual to whom complaints will be submitted; and provide an appeals process.

How is this policy being revised? In the current policy, a PIP (professional improvement plan) may be appealed (see Section 5.3 “PIP Appeal Timeline”). However, the policy does not indicate that a NOIN (Notice of improvement needed) is also appealable.
(Note: A NOIN is a non-sanction type of feedback regarding a minor or first-time performance issue that includes a plan developed by a faculty member and their supervisor.)

How is this policy being revised? Limited scope revisions will include the following:
- Update the amount to establish an endowed chair in section 4.6 from $2,000,000 to a minimum of $3,000,000.
- In section 4.7, remove “annual gift of $10,000”, and update the amount from $200,000 to a minimum of $1,000,000.
- Add a provision that these amounts could possibly be adjusted on a case-by-case basis with the approval of the Provost and Vice President of Institutional Advancement.
- Develop eligibility requirements and a standard process on how endowed chairs and professorships are awarded.

How is this policy being revised? This policy needs to be updated to comply with 2023 amendments to the Utah Clean Air Act. Key points of revision address the following:
- Policy language have been added to comply with updated state law related to e-cigarettes, vaping, and smoking paraphernalia (e-devices, pens, hookah, etc.).
- Definitions have been added to the policy to provide clarity and ensure a shared understanding of terms and concepts, improve communication, and reduce misunderstandings (for example, smoking in or near buildings and enclosed indoor place; use of tobacco, cigarettes, hookahs, cigars, e-devices, vape pens, etc.).
- Procedures have been added, so individuals know how to report concerns and potential violations to ensure incidents are handled consistently and fairly.
- Procedures have been added for handling law or policy violations and ensuring a fair, safe environment for students, faculty, and staff.
- Policy language have been added to include the limited exemption from the statute for Native American tribal religious ceremonies.
Now that this policy is in Stage 2, what does this mean for me? You may now submit comments to your elected senator or to the policy steward. Stage 2 ends January 22, 2026.

How is this policy being revised? Limited scope revisions address the following:
- Clarify personal vacation policy: Clearly state that personal vacations that interfere with holding regular class are not permissible during the semester.
- Emphasize contractual teaching period: Reinforce that faculty are expected to teach for the full duration of their contracted semesters. Faculty members are not permitted to alter or reduce their contract period.
- Ensure federal compliance with Title II: Add a provision to inform faculty about the federal compliance requirements with Title II regarding ADA technology accessibility issues on apps and course content on the internet.
