Today, March 27, 2025, UVU's President’s Council approved the following policy actions:

Who does this apply to? University leadership and personnel involved in hiring faculty

What is being revised in this policy? The faculty self-evaluation and five different categories for annual review ratings have caused much confusion. The current merit pay system is too complicated, involves too many people, and grants access to personnel files that may not be appropriate. We have simplified the merit pay process and added that content to Policy 633. This means we can now delete Policy 654 Faculty Merit Pay. Additionally, we deleted content from Policy 633 that dealt with post-tenure review because UVU now has a separate post-tenure review policy (Policy 638).

Now that this policy is in Stage 2, what does this mean for me? If you have comments or concerns, submit them to your elected representative. Stage 2 ends May 15, 2025.

What is being revised in this policy? The University’s current Policy 165 Discrimination, Harassment, and Affirmative Action includes references to “affirmative action,” although the University no longer has an active affirmative action program (AAP) in place. The policy does not define what constitutes affirmative action, and its only reference states that the EO/AA Director is responsible for maintaining an AAP in compliance with the law and must provide an annual program report of these activities. (Policy 165, Section 5.4.1)

Historically, the University maintained an AAP to comply with Executive Order 11246, which was required due to a prior federal contract. However, this contract has since expired, and recent developments—including changes in state law (HB 261), the revocation of EO 11246, and increased federal enforcement activity—make references to affirmative action outdated and potentially problematic.

Additionally, Title IX regulations require university procedures to list or describe the range of remedies that may be provided following a determination that sex-based harassment occurred. Policy 162 currently lacks this information.

Finally, updates to multiple state code references are needed to ensure accuracy and alignment with current legal standards.

Now that this policy is approved, what does this mean for me? The changes to these policies will go into effect and be implemented. No further action is required, but the changes will be ratified by the Board of Trustees at their next meeting.
